Terms & Conditions - The Wealth Spirit
This website, "The Wealth Spirit," is operated by The Wealth Spirit Ltd ("we," "us," "our").
By registering with our platform, you agree to these Terms and Conditions, governed by the laws of the United Kingdom, alongside our Privacy Policy. References to "you," "buyer," "seller," and "member" refer to registered users of our site.
How We Operate
Our website facilitates the buying and selling of premium spirits exclusively online. During registration, we collect essential information including name, address, contact details, email, and date of birth. Sellers must also provide bank details for transactions. All personal data is handled in compliance with UK Data Protection legislation, as detailed in our Privacy Policy.
It is your responsibility to maintain accurate and current personal information. We are not liable for issues resulting from inaccurate or incomplete details provided by you, and you accept full responsibility for any consequences arising from such inaccuracies. You must keep your login credentials confidential and not allow third-party access.
Age Restrictions & Compliance
We operate under UK law and adhere to relevant regulations, including minimum alcohol pricing set by the UK Government. Users must be aged 18 or over, in accordance with UK licensing laws. We reserve the right to request additional age verification and participate in the "Challenge 25" policy during deliveries. Failure to prove legal age will result in order returns at the buyer’s expense, including additional re-delivery charges.
Selling Spirits
Sellers submit spirits for valuation and sale through our website. Valuations provided are indicative only and will be confirmed upon physical receipt and inspection of the bottles. Sellers must disclose any damage during the registration process. Transportation to our warehouse is the seller's responsibility; we recommend fully trackable and secure shipping methods. We offer a collection service, but accept no liability for damage or loss during transit.
Unacceptable Items
We cannot accept:
-
Decanters or glassware
-
Bottles with damaged or broken seals
-
Bottles past marked expiry or best-before dates
We reserve the right to refuse or limit specific items or quantities.
Receipt and Verification
Upon arrival, bottles undergo thorough checks for authenticity and condition. Any discrepancies from provided descriptions may result in refusal. Sellers are responsible for return shipping costs for rejected items. Counterfeit items will be reported to authorities with full disclosure of the seller's details, destroyed, and sellers permanently barred from our platform.
Seller Payments
Sellers must provide accurate bank details for payment transfers. Errors due to incorrect bank details may incur an administrative fee (£100 + VAT) for resolution. Payments are processed via bank transfer unless otherwise agreed.
Seller Cancellation
Cancellation requests must be submitted within 14 days of item arrival. Accepted cancellations require collection arrangements (seller's expense).
Buyer Payments
We accept major credit and debit cards through our secure payment system. Non-UK/EU cards, including American Express, incur a 3.5% surcharge.
Delivery of Spirits
Upon full payment, items are securely packaged and dispatched. Delivery costs and timelines are outlined during checkout. Buyers are responsible for verifying delivery availability to their location. Local duties, taxes, or additional fees are the buyer's responsibility. All international buyers are solely responsible for ensuring compliance with their local import regulations. Given the nature of aged spirits, buyers explicitly accept full liability for potential minor leakages or damage during transport.
Buyer Cancellation
Buyers have 14 days post-delivery to request cancellation if items do not match descriptions. Cancellation requests must be in writing. Refunds, partial or full, are at our discretion upon reviewing returned items. Buyers bear return shipping and insurance costs. Orders cannot be cancelled once dispatched or collected.
Our Cancellation Rights
We reserve the right to cancel memberships and transactions due to breaches of terms, handling counterfeit goods, bankruptcy, or similar issues. Permanent bans may apply.
Member Confidentiality
Client data is securely stored per UK Data Protection legislation. Information is confidential and disclosed only if legally required. We do not share or sell data to third parties.
Liability
We accept liability for goods securely received and stored in our warehouse but not for transport-related losses. Market valuations provided are advisory; we do not accept liability for market fluctuations. Contents of sealed bottles are considered incidental; purchases are made at buyer's risk. We report counterfeit activities to relevant authorities.
Force Majeure
Neither party is liable for breaches resulting from uncontrollable events, including natural disasters, terrorism, pandemics, or similar.
Changes to Terms
We reserve the right to update these terms at any time. Continued website use signifies your acceptance of updated terms. Significant changes will be directly communicated via email.
These Terms and Conditions do not affect your statutory consumer rights.
